The words “you”, “your” or “user” means you, as a user of the platform, whether you are a patient/client or a healthcare provider. Where 'patient' is used, this can also be taken to mean 'service user' or 'client' and describes a user of the healthcare provider's services. “Platform” refers to the information hosted at halocheck.co.uk. These Terms outline the rights and obligations of Halocheck, patients, and healthcare providers regarding the use of the platform. You should read them carefully and let us know if you have any concerns or questions before proceeding to use the platform.
- Halocheck runs this website to connect healthcare providers with patients or clients. Halocheck is not responsible for the quality, effectiveness, safety, or any other aspects of a healthcare provider’s services, nor for any agreement entered into between a healthcare provider and a patient.
- These Terms of Use ('Terms') establish the basis for how the platform can be used. They do not govern the relationship between a healthcare provider and patient or client. Any arrangement made between a healthcare provider and a patient or client is a separate contract to which Halocheck is not a party and for which Halocheck holds neither liability nor responsibility.
- If you are a Healthcare Provider, your contract with us for services is referred to as your 'Membership Contract.' This is a separate agreement between you and Halocheck, detailing how you become listed, which services will be provided to you, and the applicable terms and conditions. Both these Terms of Use and the Membership Contract will apply to you as a Healthcare Provider.

Use of Website
- The platform is intended for use only by those who can access it from within the United Kingdom. While access may be possible from outside the United Kingdom, the platform is not intended for such use. You may use the platform only for lawful purposes; therefore, you may not use the platform in any way that breaches any applicable local, national, or international law or regulation.
- The platform has not been developed to meet your specific requirements. We cannot guarantee that the platform will be suitable for your specific purposes or compatible with all hardware or software you may use.
- This platform is not aimed at under 18s. By using this website, you confirm you are over the age of 18.
- To protect ourselves, the platform, and other users from fraudulent or illegal activity, we reserve the right to take necessary actions when required. This may include verifying a user’s identity, age, or other relevant details if we have reasonable grounds to believe we could be in breach of applicable laws or regulations. If we request additional information, you must provide it as soon as possible. Any information you share will be handled in accordance with our Privacy Notice. If you fail to provide the requested information, refuse to comply, or if we suspect fraudulent or criminal activity related to your listing, we may suspend or cancel your account.

We do not guarantee the completeness, accuracy, or reliability of the content provided. Users access this information at their own risk, and Halocheck, along with its partners, employees, and representatives, is not liable for any harm or consequences resulting from its use.
- Selecting a healthcare provider is an important decision and should not be based solely on the information available on this website. Patients are responsible for assessing the suitability of a provider for their specific needs.
- Healthcare providers have full discretion to accept or decline clients or patients for any reason.
- If a dispute arises between a patient and a healthcare provider, both parties agree to release Halocheck, its employees, officers, successors, and agents from any claims, damages, or losses resulting from the dispute, except in cases where Halocheck has breached these Terms.
- Halocheck reserves the right to edit digital listings and restrict access to the platform at any time without prior notice. Users are solely responsible for how they access and use the information on the platform, and Halocheck is not liable for any resulting consequences.
- All pricing displayed on the platform is provided by healthcare providers. Halocheck does not verify, approve, or underwrite these prices.
- Halocheck may provide links to third-party websites for informational purposes. However, we do not own, control, or take responsibility for these sites, their content, or any issues that arise from their use.
- Halocheck retains exclusive ownership of all rights related to the platform, including but not limited to design, text, graphics, images, logos, digital downloads, audio, video, data, software, and source code.
- We do not guarantee uninterrupted availability of the platform or its features. Periodic updates, fixes, and upgrades may be necessary.
- Updates may be downloaded automatically or may require user action. We strongly recommend installing all updates to maintain platform functionality and security.

- Healthcare providers may submit content to the Halocheck platform, including listings, patient/client reviews, text, photographs, images, and videos. Providers are fully responsible for ensuring that all content is accurate, truthful, up-to-date, genuine, and not misleading. Content must be relevant, appropriate, and compliant with our Terms, Acceptable Use Policy, and all applicable UK laws, as well as those of any country where the content is posted or viewed.4.2 By submitting content, healthcare providers grant Halocheck the right to reproduce and use their listing content for promotional purposes on the platform and in Halocheck's business activities.

- Healthcare providers must obtain explicit patient consent before publishing any photos or videos on Halocheck or any marketing channels controlled by Halocheck.
- Halocheck reserves the right to monitor and review submitted content in line with its Acceptable Use Policy. This is to ensure compliance and reduce the risk of harmful, offensive, or illegal material appearing on the platform.
- We reserve the right to edit, suspend, or remove any content that breaches our Terms or Acceptable Use Policy. Additionally, we may suspend or terminate user accounts that violate these rules.
- Any information submitted through this website, including comments, suggestions, or ideas, is voluntarily assigned to Halocheck Ltd. Users should not submit confidential or proprietary information, as Halocheck does not assume any obligation to protect or return such submissions.

Reviews
- Patients are encouraged to submit reviews of their healthcare providers. Reviews must be based on personal experiences and must not be offensive, unlawful, infringe on the rights of others, or violate our Acceptable Use Policy. Incentivized or fake reviews, including those procured by or on behalf of a provider, are strictly prohibited.
- We conduct verification checks to ensure the authenticity of submitted reviews. Halocheck reserves the right to screen, edit, or remove any review at any time.
- If you believe a review is offensive, discriminatory, defamatory, or otherwise inappropriate, you may report it by providing details of the review and your concerns. Healthcare providers also have the opportunity to respond to reviews about them.
- Once a review is reported, we will assess its content and, at our sole discretion, determine whether it should be removed from the platform.

Security
- When registering on the website, you will create a username and password. You are responsible for keeping these credentials confidential and for all activity conducted through your Halocheck account. To protect your security, safeguard your password and notify us immediately at support@halocheck.co.uk if you suspect unauthorized access.
- If we detect a security breach or unauthorized activity linked to your account, we will contact you to take corrective action. If necessary, we may suspend or cancel your account to protect the platform and other users.

Accounts
- We may offer trial access to certain services for a limited period, as specified in the commercial materials provided at the time. We reserve the right to modify or withdraw trial services at any time without notice or liability. After the trial period, access will be removed unless you choose to purchase a healthcare provider membership.
- Healthcare providers can maintain their listing by subscribing to a monthly or annual membership. Subscription pricing may vary by region and tier, with the applicable price and terms outlined in the commercial materials provided at the time of purchase. If you upgrade or modify your membership during the subscription period, updated commercial terms may apply, and pricing may be adjusted accordingly.
- All subscription prices are inclusive of VAT. You are responsible for any additional external fees or taxes related to your use of our services, including sales tax where applicable.
- Our monthly and annual subscription services do not offer refunds for individual billing periods. However, you may cancel your subscription at any time, and your access will continue until the end of your current billing cycle. No further charges will be applied after cancellation. To cancel your membership, log in to your account and update your subscription settings.

Liability
- You agree that Halocheck has no responsibility and/or liability for any errors or omissions in any content provided by a Healthcare provider. We accept no obligation to verify or review such content. We do not provide any warranties regarding the platform. In particular, we do not warrant that the platform is fit for a healthcare provider's particular purposes. If you are not happy with the platform, your sole remedy is to terminate your Halocheck membership account.
- Halocheck is not responsible for, involved in, or a party to any agreement made between a patient and a healthcare provider through this platform.
- We shall in no circumstances be liable to you in contract, tort (including negligence) or otherwise for any direct or indirect losses you may suffer as a result of use of the Site, including:
- loss of profit, anticipated profits or business;
- loss of data, including schedules of availability and booking details;
- loss of opportunity;
- loss of revenue;
- loss of goodwill or reputation;
- wasted expenditure; and/or
- consequential, special or incidental loss or damage (whether or not advised of the possibility of the same).
- Nothing in these Terms shall be construed as excluding or limiting our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any other liability that cannot be excluded by English law.
- Healthcare providers shall indemnify, keep indemnified, and hold Halocheck harmless from and against any costs, claims, losses, damages, expenses, and liabilities that Halocheck may suffer or incur arising as a result of:
- any claim or allegation in relation to content you have uploaded to the platform, including in listings and personal information; and/or
- any claim or allegation from a Client, other Healthcare provider, medical authority or other third party relating to the acts or omission of the Healthcare provider including in relation to the provision of healthcare.
- This Agreement is governed and constructed in accordance with English law and you agree to submit to the exclusive jurisdiction of the English Courts.

Rights of Termination and Suspension
- We reserve the right to suspend or terminate the account of a healthcare provider or client/patient at any time, without liability, for reasons including but not limited to:
- Providing false or unverifiable information;
- Breaching these Terms;
- Receiving complaints or being involved in disputes related to activities on the platform;
- Engaging in practices that we deem contrary to Halocheck's ethos.
- Consequences of Breach - If you breach—or we suspect you have breached—these Terms or any other applicable terms, we may take one or more of the following actions:
- Issue a formal warning;
- Suspend or terminate your access to your account and/or the platform;
- Take legal action as necessary;
- Report your activity to law enforcement authorities.
- Both you and Halocheck have the right to terminate these Terms of Use at any time, without prior notice. You may terminate your agreement with us by deleting your account and discontinuing use of the platform.

Exclusions
- If you are a patient, you have certain legal rights when using the platform. These are also known as “statutory rights” as they are derived from laws such as the Consumer Rights Act 2015. Nothing in these Terms affects these rights.
- Nothing in these Terms & Conditions shall be construed as excluding or limiting our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any other liability that cannot be excluded by English law.
